Terms of Use

By accessing or using SpellingKids in any way — including downloading, installing, launching, or browsing the App — you expressly agree to these Terms of Use and our Privacy Policy and Disclaimer, which are incorporated herein by reference. Together, these documents form the entire agreement between you and SpellingKids regarding the App.

These Terms apply to all users of the App globally, including users in India and any other jurisdiction in which the App is made available through the Google Play Store. Where a conflict exists between these Terms and any other document, these Terms shall prevail unless expressly stated otherwise.

The App is designed for students in Grades 3 through 9, which typically corresponds to ages 8 to 15. There is no minimum age for using the App's core study features, provided that a parent or guardian has reviewed and accepted these Terms on behalf of any user under 18.

• Users under 18: Must have the consent of a parent or legal guardian who agrees to these Terms on their behalf before using the App.
• Parents & guardians: By allowing your child to use the App, you agree to these Terms and accept full responsibility for your child's use of the App, including any purchases or interactions within the App.
• Compliance with local law: You represent that your use of the App does not violate any applicable law or regulation in your jurisdiction.

Subject to your compliance with these Terms, SpellingKids grants you a limited, non-exclusive, non-transferable, revocable, royalty-free licence to download and use the App on a compatible Android device that you own or control, solely for your personal, non-commercial, educational purposes.

This licence does not include the right to:

• Copy, reproduce, distribute, or publicly display any part of the App or its content.
• Modify, adapt, translate, reverse-engineer, decompile, disassemble, or create derivative works based on the App.
• Sublicense, sell, rent, lease, transfer, or otherwise exploit the App or any licence rights.
• Remove, alter, or obscure any proprietary notices, trademarks, or copyright notices within the App.
• Use the App in any way that violates applicable laws, regulations, or third-party rights.

When using SpellingKids, you agree not to engage in any of the following activities:

• Tampering: Attempting to hack, bypass, circumvent, or otherwise interfere with the App's security features, algorithms, or functionality.
• Data scraping: Using automated tools, bots, crawlers, or scripts to extract, scrape, or harvest any content from the App.
• Unauthorised access: Attempting to gain unauthorised access to any part of the App, its backend systems, or related infrastructure.
• Harmful use: Using the App to transmit viruses, malware, or any other harmful code that could damage, disable, or impair the App or any connected systems.
• Commercial exploitation: Using the App's word lists, flashcard content, or any other material for commercial purposes without prior written consent from SpellingKids.
• Misrepresentation: Impersonating any person or entity, or falsely representing your affiliation with SpellingKids or any other organisation.
• Unlawful use: Using the App in any manner that violates applicable local, state, national, or international laws or regulations.

The App and all of its contents — including but not limited to the software code, user interface design, graphics, logos, typography, flashcard word lists, IPA pronunciations, definitions, etymologies, study algorithms, and any other materials — are the exclusive intellectual property of SpellingKids and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you. The limited licence granted in Section 3 does not constitute a transfer of any ownership interest in or to the App or its content.

All content within the App — including word lists, definitions, IPA pronunciations, language origins, and study schedules — is provided exclusively for personal educational and spelling bee preparation purposes for students in Grades 3 through 9. The App is intended to complement, not replace, formal classroom instruction or other study resources.

While SpellingKids makes every reasonable effort to ensure that content is accurate, complete, and current at the time of publication, no guarantee is made as to the absolute accuracy or completeness of any content. Language evolves, competition word banks change, and occasional errors may occur. Users are encouraged to cross-reference critical vocabulary with official competition word lists and authoritative dictionaries.

The App is free to download and use. To support continued development, the App may display third-party advertisements served by Google AdMob and other advertising partners. By using the App, you acknowledge and agree to the display of these advertisements.

• Advertisements are served by third-party ad networks and are subject to their own terms and privacy policies.
• SpellingKids does not endorse and is not responsible for the content, accuracy, or availability of any advertised products or services.
• All advertisements displayed in the App comply with Google Play's Families Policy and are filtered for appropriateness. Interest-based advertising is not served to users identified as being under the age of 13.
• You may limit personalised advertising on your device by adjusting your Android Advertising settings. See our Privacy Policy for instructions.

The App is provided on an "as is" and "as available" basis, without any representation, warranty, or condition of any kind — whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, SpellingKids expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• Any warranty that the App will meet your requirements or be suitable for your specific spelling bee competition.
• Any warranty that the App will be available without interruption, error, or security breach.
• Any warranty that defects or bugs will be identified or corrected within any particular timeframe.
• Any warranty that the App will be compatible with all Android devices, operating system versions, or network configurations.

To the fullest extent permitted by applicable law, SpellingKids, its affiliates, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of, or inability to use, the App. This includes, without limitation:

• Loss of study data, progress history, or scheduled review cards.
• Loss of competition opportunities, prizes, or educational outcomes.
• Device damage, data loss, or security breaches not caused by SpellingKids's wilful misconduct.
• Any losses resulting from reliance on inaccurate or outdated word entries within the App.
• Any losses arising from temporary unavailability of the App or interruption of service.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless SpellingKids and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use or misuse of the App in violation of these Terms.
• Your violation of any applicable law, regulation, or third-party right (including intellectual property or privacy rights).
• Any content or data you submit, transmit, or make available through the App.
• Any dispute between you and a third party relating to your use of the App.

SpellingKids reserves the right to modify, suspend, or permanently discontinue the App or any part of its features or content at any time, with or without notice. This includes changes to word lists, study algorithms, user interface design, and advertising arrangements.

• App Updates: We recommend enabling automatic updates on the Google Play Store so you always have access to the latest content, security patches, and feature improvements. Updated Terms may be bundled with App updates.
• Terms Updates: We may revise these Terms at any time. Material changes will be communicated via an in-app notification or the Google Play Store "What's New" section. Continued use of the App after changes are published constitutes your acceptance of the revised Terms.
• Termination by SpellingKids: We may immediately terminate or suspend your licence to use the App without prior notice if you breach any provision of these Terms or engage in conduct that we reasonably believe is harmful to the App, its users, or SpellingKids's legitimate interests.
• Termination by You: You may terminate your use of the App at any time by uninstalling it from your device. Uninstalling the App constitutes your withdrawal from these Terms, though provisions that by their nature should survive termination (such as intellectual property rights and limitation of liability) shall remain in effect.

These Terms of Use and any dispute, claim, or controversy arising out of or in connection with them — including their formation, validity, interpretation, performance, or termination — shall be governed by and construed exclusively in accordance with the laws of India, without regard to its conflict-of-law principles.

Any dispute that cannot be resolved amicably between the parties within 30 days of written notice shall be referred to and finally resolved by the competent courts located in India, to whose exclusive jurisdiction both parties irrevocably submit.

• Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
• No Waiver: SpellingKids's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Entire Agreement: These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and SpellingKids regarding the App and supersede all prior agreements, representations, or understandings.
